Canadian Based Lawyer Miguna Miguna took to his Twitter page to condemn with the strongest terms the action that the Kenyan government had allegedly taken to deny him from traveling to his home country.
Miguna was a few hours from traveling back to Kenya, but things took another twist after Justice Ong’udi ruled in His favor.
A Nairobi court issued 72 hours emergency documents to Miguna.
Miguna Miguna, through his lawyers, was directed to get his travel documents from either High Commission in Canada or Mission in Germany within 72 hours for him to travel back to Kenya.
In the ruling, Judge Hedwig Ong’udi indicated that Miguna had never applied for a passport, noting that he cannot use his identity card as a travel document.

I explained to Alexander Karuma that an appeal would not stay the order: that whoever did not want to comply must obtain a stay order from the Court of Appeal. He then turned around and claimed that I had gone to the Embassy “too fast.” He was rude and hostile throughout.Miguna
“Upon landing, he be allowed to use his ID for purposes of identification,” she noted.

Justice Ong’udi said, “This information must have been relayed to the petitioner as it is not denied. From the records, there is no evidence to show that the applicant has ever applied for a new passport or a renewal’ of the old one.”
According to Justice Ong’udi, “The applicant was at liberty to visit the Kenya High Commission in Ottawa, Canada, where he would be issued with a one-way emergency travel certificate to enable him to travel to Kenya.”
Miguna wrote, “Deputy Head of Mission, Esther Nyambura Mungai, Matilda Lijembe, Emma Malinda and Alexander Karuma refusing to comply with Justice Ong’udi’s Order.”

Lawyer Miguna had planned to travel home on 16 November 2021, but he was denied travel documents due to the red alert issued to the Airline by the Kenyan government.
He might have to wait even longer.
